- บุตรของบุคคลสัญชาติไทยที่เกิดในประเทศนิวซีแลนด์สามารถขอสูติบัตรไทยและได้รับสัญชาติไทยได้หากเข้าข่ายกรณีใดกรณีหนึ่งดังต่อไปนี้

   (1) มารดาเป็นบุคคลสัญชาติไทย หรือ
   (2) บิดาและมารดาเป็นบุคคลสัญชาติไทยทั้งคู่ หรือ
   (3) บิดาเป็นบุคคลสัญชาติไทย/มารดาเป็นบุคคลต่างชาติ ซึ่งได้จดทะเบียนสมรสกันตามกฎหมาย

- ในกรณีที่บิดาเป็นบุคคลสัญชาติไทยและมารดาเป็นบุคคลต่างชาติ และไม่ได้จดทะเบียนสมรสกันตามกฎหมาย บุตรจะไม่ได้รับสัญชาติไทย และหากได้จดทะเบียนภายใต้กฎหมายนิวซีแลนด์ ให้นำใบทะเบียนสมรสนิวซีแลนด์ไปผ่านกระบวนการรับรองเอกสาร ขั้นตอนการรับรองเอกสารนิวซีแลนด์คลิ๊กที่นี่เพื่อนำเอกสารนิวซีแลนด์ไปใช้ในประเทศไทย โดยจำเป็นต้องผ่านการรับรองเอกสารจากกรมการกงสุล กระทรวงการต่างประเทศของไทย จากนั้นนำเอกสารไปแจ้งจดทะเบียนฐานะครอบครัว (คร. 22) ที่อำเภอในประเทศไทยก่อน ถึงจะนำเอกสารมาแจ้งเกิดบุตรกับสถานทูตฯ ได้ 

1. ขั้นตอนการดำเนินการ

• ติดต่อสถานเอกอัครราชทูตฯ ด้วยตนเองในวันและเวลาราชการ หรือดาวน์โหลดแบบฟอร์มและกรอกข้อมูลให้ครบถ้วน
  • แบบฟอร์มสูติบัตร 
  • คำร้องขอนิติกรณ์
• กรณีที่บิดา-มารดาไม่ได้จดทะเบียนสมรสกันตามกฎหมาย แต่ต้องการให้บุตรใช้นามสกุลของบิดา จะต้องมีหนังสือยินยอมจากทั้งบิดาและมารดาเพื่อรับรองว่า ทั้งสองฝ่ายยินยอมให้บุตรใช้นามสกุลของบิดา 
  • แบฟอร์มหนังสืออนุญาตให้ใช้ชื่อสกุลในการขอสูติบัตร
• ส่งแบบฟอร์มที่กรอกเรียบร้อยแล้วมายังสถานเอกอัครราชทูตฯ พร้อมเอกสารประกอบตามข้อ 2

2. เอกสารประกอบ 

    2.1 หนังสือเดินทางของบิดา-มารดา หรือสำเนาพร้อมรับรองสำเนาถูกต้อง (ที่ยังไม่หมดอายุ)
    2.2 บัตรประชาชนของบิดา-มารดา หรือสำเนาพร้อมรับรองสำเนาถูกต้อง (ที่ยังไม่หมดอายุ)
    2.3 สำเนาทะเบียนบ้านของบิดา-มารดา พร้อมรับรองสำเนาถูกต้อง
    2.4 ใบแจ้งการเกิดของนิวซีแลนด์ (NZ Birth Certificate) ซึ่งได้รับการรับรองเอกสาร (Authentication) โดย Department of Internal Affairs (DIA)  และ Ministry of Foreign Affairs and Trade (MFAT) ของนิวซีแลนด์แล้ว
    2.5 ทะเบียนสมรส (หากมี)
          * กรณีที่มารดาไม่ใช่บุคคลสัญชาติไทย จะต้องมีเอกสารอย่างใดอย่างหนึ่งดังต่อไปนี้:
              - ทะเบียนสมรสไทย (ตัวจริงหรือสำเนา)
              - ทะเบียนสมรสนิวซีแลนด์ ซึ่งผ่านการรับรองเอกสาร (Authentication) โดย DIA และ MFAT แล้ว
    2.6 รูปถ่ายบุตรขนาด 3.5 x 4.5 ซม. จำนวน 1 ใบ
    2.7 ซอง Courier จำนวน  1 ซอง พร้อม tracking Number จ่าหน้าซองถึงตัวท่านเอง เพื่อให้สถานเอกอัครราชทูตฯ ส่งสูติบัตรคืน (ในกรณีที่จะไม่รับสูติบัตรที่สถานเอกอัครราชทูตฯ ด้วยตนเอง)

    2.8 หากได้เคยแจ้งเกิดบุตรที่สถานเอกอัครราชทูตฯ แล้วก่อนหน้านี้ กรุณาสำเนาสูติบัตรของบุตรคนก่อนมาด้วย

* NZ Birth Certificate ที่ยังไม่ผ่านการรับรองโดย DIA และ MFAT จะไม่สามารถใช้ยื่นประกอบการขอออกสูติบัตรไทยได้สถานทูตฯ จะดำเนินส่งเอกสารทั้งกลับคืนเพื่อให้ท่านดำเนินการรับรองเอกสารให้เรียบร้อย

Once you have selected “Thailand” it will show a message telling you that Thailand is a “Category A authentication country” which means that when you are asked what type/category of authentication you require from DIA you will have to choose “Category A Authentication”. In the next step you will have to download a and fill out a request form.  The completed form and  NZ Birth Certificate and Marriage Certificate can be submitted to DIA in person, by post or by courier. DIA will forward your document to MFAT to complete the authentication process and send the documents back to you.

3. ไม่มีค่าธรรมเนียมสำหรับการจดทะเบียนเกิดบุตร      

หมายเหตุ:

• หากบิดามารดาไม่ได้จดทะเบียนสมรสกันตามกฎหมายแต่ต้องการให้บุตรใช้นามสกุลของบิดา ต้องมีหนังสือยินยอมจากทั้งบิดาและมารดา 
• การเพิ่มชื่อบุตรเข้าในทะเบียนบ้าน จะสามารถกระทำได้เมื่อเดินทางกลับประเทศไทยแล้วเท่านั้น โดยบุตรจะต้องมีสูติบัตรที่ออกโดยสถานเอกอัครราชทูตฯ และหนังสือเดินทางไทย หรือเอกสารการเดินทางประเภทอื่นที่ออกโดยสถานเอกอัครราชทูตฯ ที่มีตราประทับของสำนักงานตรวจคนเข้าเมือง แสดงวันที่เดินทางเข้าประเทศไทย และนำหลักฐานดังกล่าวไปแสดงต่อนายทะเบียนเพื่อเพิ่มชื่อบุตรเข้าทะเบียนบ้านต่อไป
• การมีเลขประจำตัวประชาชน 13 หลัก และการได้สัญชาติไทย เมื่อออกสูติบัตรแล้ว เด็กจะได้เลขประจำตัวประชาชน 13 หลัก และได้สัญชาติไทย โดยชื่อเด็กจะอยู่ใน “ทะเบียนบ้านสำหรับคนเกิดและรับแจ้งเกิดในต่างประเทศ” บิดา/มารดาสามารถเพิ่มชื่อเด็กเข้าทะเบียนบ้านที่ประเทศไทยได้ในภายหลัง โดยดำเนินการด้วยตนเอง หรือ มอบอำนาจให้ผู้อื่นดำเนินการแทน โดยขอให้ท่านโปรดติดต่อสอบถามสำนักงานเขต/อำเภอที่มีภูมิลำเนาอยู่ ก่อนดำเนินการขอหนังสือมอบอำนาจกับสถานทูตฯ เนื่องจากบางสำนักงานเขต/อำเภอที่มีภูมิลำเนา ยังประสงค์ให้ บิดา/มารดา ของเด็กดำเนินการด้วยตนเองเท่านั้น
• หลังจากได้รับสูติบัตรจากสถานเอกอัครราชทูตฯ แล้ว กรุณาตรวจสอบความถูกต้องของเอกสาร และหากพบข้อมูลที่ไม่ถูกต้องในสูติบัตร กรุณาติดต่อสถานเอกอัครราชทูตฯ ภายใน 7 วันนับตั้งแต่วันที่ออกสูติบัตร ที่หมายเลข 04-496-2900 

- To obtain a Thai birth certificate for a child that is born in New Zealand, the child must meet one of the following critieria:

    (1) If the mother is a Thai national 
    (2) If both the mother and father are Thai nationals 
    (3) If the father is a Thai national and the mother is a foreign national, a marriage certificate will be required

- If the father is a Thai national and the mother is a foreign national, and the father and mother are not legally married, the child will not be eligible for a Thai birth certificate.

1.  Procedures for Registering a Birth

• Contact the Royal Thai Embassy in person during office hours or download and fill out the required forms
  • Birth Certificate Request Form 
  • Legalization Application Form
• If the mother and father of the child are not legally married and wishes for the child to use the father's surname, a letter of consent for the child to adopt the father's surname.

• Submit the above-mentioned forms together with all other required documents mentioned in section 2.        

2.  Required Documents
    
2.1  If the child’s parents are married:
       1.  A recent (3.5 x 4.5 cm) photograph of the child
       2.  * New Zealand Birth Certificate, authenticated by the Department of Internal Affairs (DIA) and the Ministry of Foreign Affairs (MFAT)
       3.  Valid passports of both parents
       4.  Valid Thai identity card(s) and a copy of the Thai house registration of the Thai parent(s)
       5.  Parents' Thai marriage certificate or NZ marriage certificate
            * If the mother is a non-Thai national and the marriage certificate is issued by NZ authorities, the NZ marriage certificate must be authenticated by DIA and MFAT  
 
2.2  If the child’s parents are not married:
       1.  A recent (2 x2 inches) photograph of the child
       2.  * New Zealand Birth Certificate, authenticated by the Department of Internal Affairs (DIA) and the Ministry of Foreign Affairs  (MFAT)
       3.  Valid passports of both parents
       4.  Valid Thai identity card(s) and a copy of the Thai house registration of the Thai parent(s) 
       5.  Other Documents:
            - If the child wishes to use the father's surname - A Request Form is to be signed in person at the Royal Thai Embassy with the presence of a consular officer
            - For cases of lost contact with the father - A copy of a child custody order or "Por. Kor. 14" will be required

2.3  If the child’s parents are divorced:
       1.  A recent (2 x2 inches) photograph of the child
       2.  * New Zealand Birth Certificate, authenticated by the Department of Internal Affairs (DIA) and the Ministry of Foreign Affairs (MFAT)
       3.  Valid passports of both parents
       4.  Valid Thai identity card(s) and a copy of the Thai house registration of the Thai parent(s)
       5.  Original copy of Child Custody Document 
       6.  Original copy of Divorce Certificate

If you have notified the birth of a child at the embassy already before. Please bring a copy of the birth certificate of the previous child. 

* NZ Birth Certificates that have not been authenticated by DIA and MFAT will not be accepted
* For information on authentication of NZ Certificates, please contact the Department of Internal Affairs

All required documents, the applicant may submit the application by courier. A self-addressed courier bag with tracking number is required for returning the “Birth Certificate” to the applicant.

3. No fee of Thai Birth Certificate

Note: After the receipt of the Birth Certificate from the Royal Thai Embassy, please check the accuracy of the document. Should you find any discrepancies in the document, please contact the Embassy at 04-496-2900 within 7 days from the date of the issuace of the Birth Certificate.
