การรับรองเอกสารจ้างงาน

เพื่อเป็นการคุ้มครองสิทธิประโยชน์ของแรงงานไทยที่จะเดินทางมาทำงานในประเทศนิวซีแลนด์ ตาม พ.ร.บ.จัดหางานและคุ้มครองคนหางาน พ.ศ. 2528 มาตรา 48 (คนงานหางานด้วยตนเอง) สถานเอกอัครราชทูต ณ กรุงเวลลิงตัน ได้กำหนดแนวทางการรับรองเอกสารจ้างงาน ดังนี้

1. นายจ้างในต่างประเทศหรือลูกจ้างส่งร่างเอกสารจ้างงานมายังสถานเอกอัครราชทูตฯ (อีเมล [email protected] ) เพื่อให้สถานเอกอัครราชทูตฯ ตรวจสอบเนื้อหาและความครบถ้วนของเอกสารก่อน ทั้งนี้ นายจ้างจะต้องจัดส่งเอกสารการจ้างงาน ซึ่งประกอบด้วย 1) สัญญาจ้างงาน 2) เอกสารคำบรรยายลักษณะงาน (Job Description) 3) หลักฐานการจดทะเบียนประกอบกิจการของนายจ้าง (Certificate of Incorporation) 4) รูปถ่ายสถานที่ทำงาน / สถานที่พักที่จัดให้ลูกจ้าง (หากมี) 5) สำเนาหน้าหนังสือเดินทางของลูกจ้าง* 6) สำเนาวีซ่าทำงาน* (work visa) ของลูกจ้าง 7) สำเนาบัตรโดยสารเครื่องบินอิเล็กทรอนิกส์ (e-ticket) ของลูกจ้าง (หากมี) และ 8) หมายเลขโทรศัพท์ของลูกจ้าง (โทรศัพท์มือถือ) มาให้สถานเอกอัครราชทูตฯ ประกอบการพิจารณา ทั้งนี้ สถานเอกอัครราชทูตฯ ขอสงวนสิทธิ์ในการตรวจสอบเอกสารจ้างงานต่อเมื่อได้รับเอกสารครบถ้วนแล้วเท่านั้น รวมทั้งเดินทางไปตรวจสอบสถานที่ทำงานของนายจ่้าง หากเห็นว่าจำเป็น

 

สำหรับกรณี Recognised Seasonal Employer: RSE Scheme กรุณาแนบเอกสารเพิ่มเติมมากับเอกสารจ้างงาน ได้แก่ a) รายชื่อพร้อมรายละเอียดหนังสือเดินทางของลูกจ้าง อาทิ ATR approval number, หมายเลขหน้งสือเดินทาง วันเดือนปีเกิด วันผลิต/วันหมดอายุของหนังสือเดินทาง ฯลฯ และ b) สำเนา Agreement to Recruit (ATR) Letter) 

* กรณี RSE Scheme สามารถใช้รายชื่อพร้อมรายละเอียดหนังสือเดินทางของลูกจ้างและสำเนา ATR Letter แทนสำเนาหนังสือเดินทางของลูกจ้างและสำเนาวีซ่าทำงานได้

2.  สถานเอกอัครราชทูตฯ จะตรวจร่างเอกสารจ้างงาน โดยพิจารณาสาระสำคัญของร่างสัญญาจ้างงานให้เป็นไปตามที่กฎหมายท้องถิ่นกำหนด ทั้งในประเด็นอัตราค่าจ้างแรงงาน เวลาทำงาน สถานที่ทำงาน การทำงานล่วงเวลา สวัสดิการ วันหยุดประจำปี การยุติสัญญาฯ ฯลฯ 

3. เมื่อสถานเอกอัครราชทูตฯ ตรวจสอบเอกสารจ้างงานครบถ้วนแล้ว จะแจ้งข้อเสนอแนะตามแนวทางของกระทรวงแรงงานของไทยให้นายจ้างหรือลูกจ้างทราบ ระยะเวลาการตรวจสอบเอกสารเป็นไปตามลำดับก่อนหลัง ไม่สามารถกำหนดเวลาได้ ซึ่งอาจใช้เวลาประมาณ 3-4 สัปดาห์ โดยอาจขอให้นายจ้างพิจารณาแก้ไขและ/หรือเพิ่มเติมเนื้อหา/ เอกสารจ้างงานตามข้อเสนอแนะที่ได้รับของสถานเอกอัครราชทูตฯ หากนายจ้างมีความคิดเห็นที่แตกต่างกับข้อเสนอแนะของสถานเอกอัครราชทูตฯ  สถานเอกอัครราชทูตฯ จะส่งเอกสารจ้างงานดังกล่าวให้กระทรวงแรงงานของไทยพิจารณา และสถานเอกอัครราชทูตฯ จะแจ้งผลการพิจารณาของกระทรวงแรงงานฯ ให้นายจ้าง/ ลูกจ้างทราบต่อไป 

4. เมื่อสถานเอกอัครราชทูตฯ ได้ตรวจสอบเนื้อหาของเอกสารจ้างงานว่ามีเนื้อหาและเอกสารประกอบครบถ้วนแล้ว สถานเอกอัครราชทูตฯ จะแจ้งยืนยันกับนายจ้างหรือลูกจ้าง หลังจากนั้น นายจ้างและลูกจ้างลงนามในสัญญาจ้าง

5. นายจ้างนำเอกสารการจ้างงานที่ลงนามแล้วตามข้อ 4 ได้แก่ สัญญาจ้างงานที่ลงนามโดยนายจ้างและลูกจ้าง เอกสารคำบรรยายลักษณะงาน (๋Job Description) และหลักฐานการจดทะเบียนประกอบกิจการของนายจ้าง (Certificate of Incorporation) โดยรวมเอกสารทั้งหมดเป็นชุดเดียว ไปผ่านการรับรองลายมือชื่อของนายจ้าง (certify genuine signature of the Employer) จาก Notary Public (ในเมืองหรือเขตที่ธุรกิจตั้งอยู่)*

* สำหรับกรณี RSE กรุณานำเอกสารจ้างงาน ได้แก่ สัญญาจ้างงานที่ลงนามโดยนายจ้าง เอกสารคำบรรยายลักษณะงาน (๋Job Description) หลักฐานการจดทะเบียนประกอบกิจการของนายจ้าง (Certificate of Incorporation) รายชื่อพร้อมข้อมูลหนังสือเดินทางของลูกจ้าง และสำเนา Agreement to Recruit (ATR) Letter) ตามข้อ 1 แนบรวมเอกสารทั้งหมดเป็นชุดเดียวกัน ไปผ่านการรับรองลายมือชื่อ (certify genuine signature) ของนายจ้างจาก Notary Public (ในเมืองหรือเขตที่ธุรกิจตั้งอยู่) ขอให้สำเนาเอกสารทั้งหมดภายหลังที่ผ่าน Notary Public ก่อนส่งไปรับรองเอกสารกับ Department of Internal Affairs (DIA)และ Ministry of Foreign Affairs and Trade (MFAT) ส่งมาให้สถานทูตฯ ด้วย 

6. นายจ้างนำเอกสารที่ผ่านการรับรองลายมือชื่อของนายจ้างตามข้อ 5 ไปผ่านการรับรองลายมือชื่อที่ Department of Internal Affairs (DIA) และส่งไปยัง Ministry of Foreign Affairs and Trade (MFAT) เพื่อรับรองรายมือชื่อก่อน จึงจะนำมาให้สถานเอกอัครราชทูตฯ ลงนามรับรองลายมือชื่อของเจ้าหน้าที่กระทรวงการต่างประเทศของนิวซีแลนด์ เป็นลำดับสุดท้าย

7. ผู้ยื่นคำร้องสามารถยื่นคำร้องด้วยตนเอง และกรุณานัดหมายล่วงหน้า โทรศัพท์ 04-496-2916 หรือส่งคำร้องนิติกรณ์ แบบฟอร์มคำร้องนิติกรณ์  และเอกสารการจ้างงานที่ผ่านการรับรองตามกระบวนการแล้ว พร้อมสำเนา 1 ชุด, ค่าธรรมเนียมการรับรองเอกสารฉบับละ 30 ดอลลาร์นิวซีแลนด์ จ่ายด้วยเงินสด หรือ การโอนเงินผ่านบัญชีธนาคาร (bank transfer) และซอง Courier จำนวน  1 ซอง พร้อม tracking Number จ่าหน้าซองถึงตัวท่านเอง (หากต้องการให้สถานเอกอัครราชทูตฯ ส่งเอกสารคืนให้ทางไปรษณีย์) ส่งไปที่ Royal Thai Embassy, PO Box 12247, Thorndon, Wellington 6144

หมายเหตุ

1. เอกสารการจ้างงานต้องระบุประเภทหรือลักษณะงาน สถานที่ทำงาน อัตราค่าจ้าง ชั่วโมงทำงาน ระยะเวลาการจ้างงาน สวัสดิการของคนงานที่จะได้รับ ฯลฯ

2. สถานเอกอัครราชทูตฯ ขอสงวนสิทธิ์ไม่สามารถรับรองเอกสารจ้างงานในกรณีดังนี้

    2.1 เอกสารจ้างงานไม่ได้ผ่านการตรวจสอบความถูกต้องและครบถ้วนของเอกสารจากสถานเอกอัครราชทูตฯ ก่อนนำไปผ่านขั้นตอนการรับรองเอกสารตามข้อ 5  

    2.2 เอกสารการจ้างงานที่ผ่านการรับรองลายมือชื่อตามกระบวนการข้อ 5 มีเนื้อหาและเอกสารแนบที่แตกต่างหรือเพิ่มเติมจากเอกสารที่ผ่านการตรวจสอบของสถานเอกอัครราชทูตฯ

3. สถานเอกอัครราชทูตฯ ยินดีให้คำแนะนำรูปแบบสัญญาที่มีเนื้อหาทีเหมาะสมตามรูปแบบของกระทรวงแรงงานของไทยให้กับนายจ้าง/ ลูกจ้างก่อนลงนามในสัญญาจ้าง

4. สถานเอกอัครราชทูตฯ ไม่สามารถรับรองเอกสารจ้างงานย้อนหลัง (กรณีการว่าจ้างเกิดขึ้นแล้วและแรงงานไทยอยู่ในนิวซีแลนด์แล้ว)

Procedure concerning Legalization of Employment Agreement at the Royal Thai Embassy, Wellington

 

In order to protect Thai citizens who wish to work in New Zealand in accordance with the Thai Labour Act B.E. 2528 article 48, the Royal Thai Embassy, Wellington requires the following step-by-step procedure to be followed to legalize the Employment Agreement at the Royal Thai Embassy.

 

1. The Employer and the Employee prepare “employment documents,” which shall include (1) draft Individual Employment Agreement (English version) (2) Job Description (3) a copy of Certificate of Incorporation, (4) copies of the Employee’s approved work visa* (5) Employee’s passport page*, (6) photos of the working place and the accommodation (if any) which will be provided by the Employer and (7) the Employee's telephone number (mobile phone) and (8) the Employee's confirmed travel itinerary (e-ticket) (if any). The Employer or the Employee send the above-mentioned employment documents via email at [email protected]

(In case of Recognised Seasonal Employer: RSE Scheme, please include additional documents i.e. a) name list of employees with their passport details e.g. ATR approval number, passport numbers, dates of birth, issue/ expiry dates, etc. and b) a copy of Agreement to Recruit (ATR) Letter to the Employment Agreement.

Note: The Embassy reserves the right to consider only the complete “employment documents” and to visit the working place, if deemed necessary.

* For the case of RSE Scheme, name list of employees with their passport details together with a copy of ATR Letter can be used in lieu of copies of the employees' work visas and passport pages

 

2. The Embassy will take into consideration the contents of the Individual Employment Agreement, namely; wage, welfare, holiday and leave, working time, overtime and holiday payment, termination of contract, in compliance with the local Labour Law.

Note: The Embassy has the authority to decline legalization of Employment Agreement if there is any indication of labour exploitation in the contents of that Agreement.

 

3. The Embassy will then, on a separate note, inform the Employee or the Employer of recommendations in accordance with the guidleines from the Thai Ministry of Labour once it has completed its consideration of the “employment documents.” Time required for this may depend on the priority and the consular officer’s work assignment. Normally, it may take up to 3-4 weeks. The Embassy may ask the Employer consider amending and/or add some contents in the Employment Agreement. The Employer may wish to differ from the Embassy's recommendations. The Embassy shall submit the Employment Agreement to the Thai Ministry of Labour for consideration. The Embassy shall inform the Employer once the official determination is made by the Ministry of Labour.

 

4. Both the Employee and the employer are advised to sign or initial their name on each page of the Agreement in order to avoid any question that may arise concerning the amount of salary or the period of employment or other details.

 

5. Once the Embassy informs the Employer of the approval, the employer submits in one bundle the original copy of the employment documents, namely (1) original copy of the signed Individual Employment Agreement by the Employer and the Employee (English version) and (2) Job Description and (3) Certificate of Incorporation to the local Notary Public to certify the genuine signature of the Employer.* 

*In case of RSE Scheme, please submit in one bundle (1) original copy of the signed Individual Employment Agreement (English version) (2) Job Description (3) name list of employees with their passport details e.g. ATR Approval Number, passport numbers, dates of birth, issue/ expiry dates, etc. (4) a copy of Agreement to Recruit (ATR) Letter to the Employment Agreement and (5) Certificate of Incorporation to the local Notary Public to certify the genuine signature of the Employer.  

 

6. The employer submit the above notarised employment document to the Department of Internal Affairs (DIA) and Ministry of Foreign Affairs and Trade (MFAT) in Wellington for their authentications in one bundle, respectively

7. Subsequently, the Employer submits the original copy of the MFAT's authenticated bundle of “employment documents” to the Royal Thai Embassy in Wellington for final legalization, acknowledging the signature of the officer of the Ministry of Foreign Affairs and Trade of New Zealand - Together with a photocopy of the documents.

 

8. Applicant may submit the application in person, thereby requiring that applicant make an appointment in advance via telephone at 04-496-2916. Fill out required form Legalization Application FormAlternatively, the applicant may submit the application by courier. The application fee for legalization is $30 NZD cash or bank transfer, payable to the Royal Thai Embassy. A self-addressed courier bag with tracking number is required for returning the “employment documents” to the applicant.

 

Additional Remarks:

1. The Embassy reserves the right to decline any application for legalization of “employment documents” as follows;

1.1 The content and the completeness of the “employment documents” have not been pre-approved by the Embassy before submitting to authentication/ legalization as in procedure no. 5

1.2 The content and completeness of the “employment documents,” which has been authenticated/ legalized in procedure no.5 are different from the Embassy’s earlier approved version.    

2. The Embassy is pleased to give advice on the appropriate wording in the Employment Agreement in accordance with the guidelines of the Thai Ministry of Labour to the Employer and the Employee before sigining the Agreement.   

3. The Embassy is unable to legalize the Employment Agreement that is already effective, i.e. the employment is already atarted and the employee is already in New Zealand.
